Overseas travel terms

Overseas Travel Standard Terms and Conditions
(Approved by the Fair Trade Commission on December 19, 2014, Revised)
The travel agency (hereinafter referred to as "Party A") engaged in overseas travel and the traveler (hereinafter referred to as "Party B") wishing to travel abroad enter into the following contract regarding overseas travel.

Article 1 (Purpose)
This agreement is intended to specify the detailed implementation and compliance requirements of the overseas travel contract concluded between '이공일컴퍼니(주)' and the traveler.

Article 2 (Duties of the Travel Agency and Traveler)
① The travel agency must faithfully perform the tasks entrusted to it in the process of planning and executing the travel itinerary, including travel arrangements, guidance, transportation, and accommodation, in order to provide the traveler with safe and satisfactory travel services. ② The traveler must actively cooperate to promote harmony among travelers and maintain travel order as instructed by the travel agency for safe and enjoyable travel.

Article 3 (Definition of Terms)
The types and definitions of travel, as well as the definition of overseas travel agency services, are as follows:
1. Packaged Tour: A tour conducted by a travel agency that recruits travelers by advertising or other means, specifying the destination, itinerary, services provided to travelers (hereinafter referred to as "travel services"), and travel fares in advance.
2. Customized Tour: A tour conducted by a travel agency based on the traveler's (individual or group) desired travel conditions, planning and conducting a comprehensive itinerary including transportation, accommodation, and sightseeing.
3. Overseas Travel Processing Agency Contract (hereinafter referred to as "Processing Agency Contract"): A contract in which the travel agency agrees to receive a specified processing fee from the traveler and, upon the traveler's commission, handles the following tasks (hereinafter referred to as "processing agency tasks"):
1) Processing of visas, re-entry permits, and various certificates
2) Preparation of immigration documents and other related tasks

Article 4 (Composition of the Contract)
① The travel contract consists of the travel contract form (attached) and the travel terms and conditions, travel itinerary (or travel description). ② The travel itinerary (or travel description) must include the itinerary for each travel date, including travel destinations, sightseeing activities, transportation, shopping opportunities, accommodation, meals, and other services provided by the travel agency, as well as important information for travelers.

Article 5 (Special Agreements)
The travel agency and the traveler may enter into special agreements in writing within the scope not in violation of the relevant laws and regulations. In this case, the travel agency must explain any differences from the standard terms and conditions to the traveler.

Article 6 (Provision of Safety Information and Issuance of Contract Documents)
When entering into a travel contract with the traveler, the travel agency must provide safety information about the travel destination posted on the Ministry of Foreign Affairs Overseas Safety Travel website (www.0404.go.kr), and upon conclusion of the travel contract, provide one copy each of the contract and travel itinerary (or travel description) to the traveler.

Article 7 (Deemed Provision of Contract Documents and Terms and Conditions)
The travel contract form, travel terms and conditions, and travel itinerary (or travel description) provided via the internet or other electronic networks, for which the traveler has agreed to the contents and applied for the conclusion of the travel contract, and the travel agency has notified the traveler of its acceptance through electronic networks or mechanical devices, or for which the travel agency has provided written acceptance after the traveler submitted a written application for the conclusion of the travel contract using facsimile or other mechanical devices, shall be deemed to have been provided.

Article 8 (Liability of the Travel Agency)
The travel agency shall be liable if the travel agency itself, its employees, local travel agencies, or their employees (hereinafter referred to as "agents") cause damage to the traveler due to intentional or negligent acts in relation to the duties assigned by Article 2, Paragraph 1.

Article 9 (Cancellation of Contract if Minimum Number of Participants is Not Met)
① If the minimum number of participants is not met, the travel agency must notify the traveler of the cancellation of the travel contract by 7 days before the departure date. ② If the travel agency cancels the contract due to an insufficient number of participants without notifying the traveler by the deadline specified in the preceding paragraph, the travel agency must compensate the traveler in addition to refunding the contract fee as follows:
A. If notified by 1 day before departure: 30% of the travel fare
B. If notified on the day of departure: 50% of the travel fare

Article 10 (Refusal to Enter into Contract)
The travel agency may refuse to enter into a contract with the traveler if any of the following reasons apply:
1. When it is recognized that the traveler may cause harm to other travelers or significantly disrupt the smooth conduct of the travel.
2. When it is recognized that the traveler is unable to travel due to illness or other reasons.
3. When the maximum number of participants specified in the contract has been exceeded.

Article 11 (Travel Fare)
① The travel fare specified in the travel contract includes the following items. However, for customized tours, this is subject to agreement between the parties.
1. Fare for transportation facilities such as airplanes, ships, and railways (based on regular fares).
2. Shuttle bus fares between airports, stations, ports, and hotels.
3. Accommodation and meal expenses.
4. Guide expenses.
5. Various taxes required during the trip.
6. Domestic and international airport/port taxes.
7. Tourism development fund.
8. Admission fees to tourist attractions specified in the itinerary.
9. Other expenses according to individual contracts.
② The traveler must pay a deposit (an amount equal to or less than 10% of the travel fare) to the travel agency at the time of contract conclusion, and the deposit shall be treated as part or all of the travel fare or compensation for damages. ③ The traveler must pay the remaining balance of the travel fare, excluding the deposit, to the travel agency by 7 days before departure. ④ The traveler must pay the travel fare as agreed between the parties by card, bank transfer, or other methods. ⑤ If traveler's insurance premiums are included in the customized tour fare, the travel agency must explain the insurance company's name, compensation details, etc., to the traveler.

Article 12 (Change of Travel Fare)
① If the fees to be paid to transportation/accommodation facilities during overseas travel increase or decrease by more than 5% from the time of contract conclusion, or if the foreign exchange rate applied to the travel fare increases or decreases by more than 2% from the time of contract conclusion, the travel agency or the traveler may claim an increase or decrease in the travel fare within the range of the increased/decreased amount. ② If the travel agency increases the travel fare according to the provisions of Paragraph 1, it must notify the traveler 15 days before the departure date.

Article 13 (Conditions for Changing Travel and Settlement of Fees)
① The travel conditions specified in Articles 1 to 12 may be changed only under the following circumstances:
1. When both parties agree that it is inevitable for the safety and protection of the traveler due to the traveler's request or local circumstances.
2. In case the travel objective cannot be achieved due to force

 majeure such as natural disasters, wars, and other emergencies, and when travel agencies need to change the travel itinerary or return schedule to ensure the safety of the traveler.
3. When it is necessary to change the travel itinerary or service content due to unavoidable circumstances such as sudden restrictions on the use of tourist attractions, accommodations, and transportation facilities provided for the travel itinerary.
② If the travel conditions change according to Paragraph 1, the travel agency must immediately notify the traveler and explain the reason for the change. In this case, the traveler may agree to change the travel itinerary or cancel the contract.

Article 14 (Cancellation of Contract by Traveler)
① The traveler may cancel the travel contract by paying a cancellation fee to the travel agency. ② If the traveler cancels the travel contract before departure, the travel agency may charge a cancellation fee as follows:
A. If canceled 20 days or more before departure: 10% of the travel fare
B. If canceled 8 to 19 days before departure: 20% of the travel fare
C. If canceled 1 to 7 days before departure: 30% of the travel fare
D. If canceled on the day of departure: 50% of the travel fare
③ If the traveler cancels the contract due to unavoidable circumstances such as illness or death, the travel agency must return the travel fare after deducting the minimum expenses necessary for the travel arrangements made by the travel agency.

Article 15 (Refund of Travel Fare)
① The travel agency must refund the travel fare to the traveler if the travel agency cancels the contract according to Article 9, Paragraph 1, or if the traveler cancels the contract according to Article 14, Paragraph 3. ② If the traveler cancels the contract according to Article 14, Paragraph 2, the travel agency must refund the travel fare after deducting the cancellation fee specified in the preceding paragraph. ③ If the travel agency cancels the contract due to unavoidable circumstances such as illness or death, it must return the travel fare to the traveler after deducting the minimum expenses necessary for the travel arrangements made by the travel agency. ④ If the traveler cancels the contract due to unavoidable circumstances such as illness or death, the travel agency must return the travel fare to the traveler after deducting the minimum expenses necessary for the travel arrangements made by the travel agency.

Article 16 (Postponement or Cancellation of Travel Due to Natural Disasters, Wars, or Other Emergencies)
① In case of natural disasters, wars, or other emergencies occurring after the travel contract is concluded and making it impossible to safely conduct the travel, the travel agency may postpone or cancel the travel contract. ② In the event of the postponement or cancellation of the travel contract according to Paragraph 1, the travel agency shall not be liable for any damages caused to the traveler due to the reasons specified in Paragraph 1.

Article 17 (Liability of the Traveler)
① The traveler shall be responsible for any damages caused by not following the travel agency's instructions, disrupting the smooth conduct of the travel, or failing to meet the requirements specified in the travel contract. ② If the traveler cancels the contract due to reasons other than those specified in Article 14, Paragraph 3, the travel agency may claim damages to the traveler, including the cancellation fee specified in Article 14, Paragraph 2.

Article 18 (Travel Agency's Responsibility to Notify and Provide Information)
① The travel agency must provide travelers with detailed information about their travel destinations, including information on customs, culture, and climate, as well as potential risks and precautions. ② The travel agency must provide travelers with timely and accurate information about changes to travel schedules, flight times, and other important matters.

Article 19 (Travel Agency's Responsibility to Ensure Safety)
① The travel agency must take necessary measures to ensure the safety of travelers during travel, including providing emergency contact information and responding promptly to any emergencies that may arise. ② If an accident occurs during travel due to the negligence of the travel agency or its agents, the travel agency shall be liable for damages incurred by the traveler.

Article 20 (Jurisdiction and Governing Law)
① Any disputes arising out of or in connection with this agreement shall be settled through consultations in good faith between the parties. ② If the parties fail to reach a settlement through consultations, the dispute shall be brought to the exclusive jurisdiction of the Seoul Central District Court. ③ This agreement shall be governed by and construed in accordance with the laws of the Republic of Korea.

Consumer compensation regulations for overseas travel - Amendment to the Ministry of Finance and Economy notification dated March 13, 1999 (related to Article 15 "Cancellation of Travel Contract Before Departure" of the Overseas Travel Agreement)

Compensation for damages to consumers due to cancellation of travel contract between travel agencies
1. In case the travel agency cancels the contract due to its own fault:
   - Notification up to 20 days before the departure date: Refund of travel contract deposit
   - Notification up to 10 days before the departure date: Compensation of 5% of travel expenses
   - Notification up to 8 days before the departure date: Compensation of 10% of travel expenses
   - Notification up to 1 day before the departure date: Compensation of 20% of travel expenses
   - Notification of cancellation on the day of departure: Compensation of 50% of travel expenses
2. In case there is a request from the traveler to cancel the travel contract:
   - Cancellation request up to 20 days before the departure date: Refund of travel contract deposit
   - Cancellation request up to 10 days before the departure date: Compensation of 5% of travel expenses
   - Cancellation request up to 8 days before the departure date: Compensation of 10% of travel expenses
   - Cancellation request up to 1 day before the departure date: Compensation of 20% of travel expenses
   - Notification of cancellation on the day of departure: Compensation of 50% of travel expenses
3. Exceptions to cancellation fees and compensation:
   - Exceptions are made for trips to non-recognition countries and special countries.
   - In case of the death of a relative within 3 relatives of the traveler
   - In case the traveler is unable to participate in the trip due to a major illness or injury

Expenses not included in travel expenses
Many problems arise during the trip due to guides/tour guide tips, optional tours, etc.
1. Costs not included in travel expenses:
   - Personal expenses during the trip (communication fees, customs duties, all tips, laundry fees, personally added food and drinks)
   - Excess baggage fees (usually within 20kg)
   - Costs not specifically mentioned in the itinerary (optional tours, etc.)
2. Costs included in travel expenses:
   - Fare of transportation facilities specified in the itinerary (aircraft, ships)
   - Accommodation/meal expenses specified in the itinerary (some products such as airtels, hotel packs are excluded)
   - Airport reception and transfer service fees (some products such as airtels, hotel packs are excluded)
